The Code on Wages, 2019: Modernizing Indian Labour Law
The Code on Wages, 2019, consolidates and subsumes four longstanding statutes: the Minimum Wages Act (1948), the Payment of Wages Act (1936), the Payment of Bonus Act (1965), and the Equal Remuneration Act (1976). Under the unified Code, statutory minimum wages are no longer confined to 'scheduled employments' — minimum wage protections now universally cover every worker across both organized and unorganized sectors, nationwide.
National Floor Minimum Wage & Geographic Indexation
Under Section 9 of the Code on Wages, the Central Government establishes a National Floor Wage based on minimum standard living costs across geographical zones. State governments can fix their own minimum wages provided the state rate is equal to or higher than the floor. If an existing state minimum wage is already higher than the floor, the state cannot reduce it to match the lower floor rate. Minimum wages are dynamically linked to the CPI-IW for regular inflation correction.
The 50% Wage Definition Rule & CTC Restructuring
Section 2(y) redefines 'Wages': Basic Salary, Dearness Allowance (DA/VDA), and Retaining Allowance count as wages. Allowances like HRA, Conveyance, Overtime, Bonus, and Employer PF/ESIC contributions cannot exceed 50% of gross remuneration. If allowances exceed that 50% cap, the excess is deemed 'Wages', increasing the statutory base for PF, ESI, and Gratuity.
How to Calculate Minimum Wages: 26-Day Divisor Rule
Statutory minimum wages for monthly-rated employees use a 26-working-day divisor (accounting for 4 paid weekly rest days per month): Daily Wage = Monthly Minimum Wage ÷ 26; Monthly Wage = Daily Minimum Wage × 26; Hourly Overtime Rate = (Daily Wage ÷ 8 hours) × 2.0. Employers must ensure Basic + VDA meets or exceeds this benchmark before discretionary allowances are added.
Statutory Compliance, Registers & Penalties (Section 54)
Underpayment (first offence): fine up to ₹50,000. Repeat offence within 5 years: imprisonment up to 3 months, or a fine up to ₹1,00,000, or both. Administrative defaults (failing to maintain records/file returns): fine up to ₹20,000. Employers must maintain Form I (Register of Wages), Form IV (Wage Slips), and digital attendance logs verifiable during inspections.
Common Employer Questions on Minimum Wages
What is the difference between Minimum Wage, Fair Wage, and Living Wage in India?
A Minimum Wage is the absolute statutory baseline mandated by law to provide for the bare sustenance and preservation of worker efficiency. A Fair Wage sits above the minimum wage and reflects the industry's financial capacity to pay. A Living Wage represents the highest socio-economic ideal, providing a frugal standard of comfort and security for retirement.
How frequently are minimum wage rates revised in Indian states?
Minimum wages have two components: Basic Wage and Variable Dearness Allowance (VDA). The basic wage rate is typically overhauled once every 3 to 5 years by state advisory boards. The VDA component is adjusted biannually based on fluctuations in the Consumer Price Index for Industrial Workers (CPI-IW).
Why is the monthly minimum wage divided by 26 instead of 30 or 31?
A standard work month is considered to consist of 26 working days, granting the worker 4 statutory paid weekly rest days. Dividing the monthly wage by 26 guarantees fair compensation for rest days without diluting the effective daily earning rate.
Can an employer include HRA, Conveyance, or medical allowance to meet the Minimum Wage floor?
No. Across all state jurisdictions, the statutory minimum wage must be met solely through Basic Wage + Variable Dearness Allowance (VDA). Allowances like HRA, travelling allowance, or discretionary incentives cannot bridge a shortfall in the statutory basic minimum wage.
Which state or union territory in India has the highest minimum wage?
The National Capital Territory of Delhi has consistently maintained one of the highest non-agricultural minimum wages in India (Unskilled: ₹18,456 per month, Skilled: ₹22,411 per month under the order in force from 1st April, 2025), followed closely by Kerala and Zone I of Maharashtra and Karnataka.
How does the 50% wage rule under the Code on Wages affect payroll calculations?
The Code on Wages mandates that core wages (Basic + DA) must constitute at least 50% of gross remuneration. If an employer inflates special allowances such that Basic + DA is only 35% of total pay, the remaining 15% is automatically deemed wages, increasing mandatory PF and Gratuity contributions.
Does the Minimum Wages Act apply to remote workers, freelancers, and contract gig staff?
Yes. The Code on Wages expands the statutory net to cover contract workers, agency staff, and home-based gig workers. Principal employers are vicariously liable if a staffing contractor fails to disburse minimum wages to deployed personnel on the company's premises.
What legal documents and registers must an employer maintain for minimum wage compliance?
Employers must maintain: Form I (Register of Wages) with rates, gross salary, statutory deductions, and net paid; Form IV (Monthly Wage Slips); a Register of Overtime; and a Register of Fines and Deductions.
