Retirement Age in India: What the Law Says for Government and Private Employers
No single retirement age applies to everyone in India. Central government employees generally retire at 60, states set their own ages, and private employers decide through the contract, HR policy or standing orders, with 58 or 60 common. Gratuity is payable on retirement after five years of continuous service.

People often ask for the legal retirement age in India, and the honest answer is that it depends on who you work for. There is no single national age that applies to every job.

Government employees
Central government employees generally retire at 60. State governments set their own ages, which vary by state, and some categories such as teachers, doctors and judges follow different rules. Public sector undertakings usually specify the age in their service rules.

Private sector
No central law fixes a retirement age for private employers. The age is set by the employment contract, the company's HR policy or the certified standing orders where they apply. Many private companies use 58 or 60, and some have no fixed age and rely on performance and mutual agreement.
Related ages that matter
- ✓EPF pension: Members can receive a pension at 58, and early pension is possible from 50 with a reduction.
- ✓EPF withdrawal: Full withdrawal rules link to retirement, which is generally at 58 for PF purposes.
- ✓Gratuity: Payable on retirement, resignation or death after five years of continuous service, with exceptions.
- ✓Senior citizen age: Tax benefits begin at 60.

Writing a good retirement policy
- ✓State the normal retirement age and the date on which employment ends.
- ✓Explain if extensions are possible, and how they are approved.
- ✓Describe the final settlement, including gratuity, leave encashment and PF.
- ✓Provide a path for phased or part-time retirement if you want to keep critical skills.
Preparing employees and the business
- ✓Start knowledge transfer a year before the date.
- ✓Build a succession plan for the role.
- ✓Offer retirement counselling on pensions and finances.
- ✓Mark the occasion, since a respectful farewell shapes how current staff feel.
Age discrimination
Be careful to apply the policy consistently, so that nobody is forced to leave earlier than others in similar roles without a documented reason.
Retirement planning starts years before the last working day, for the employee and for the team.
If your company operates in several states or has government contracts, check which rules apply and keep the policy in writing.
