Probation Period Rules in India: What Employers Must Know
No single central law defines probation. State Shops and Establishments Acts and your appointment letter govern it. Probation typically lasts 3 to 6 months, can be extended in writing with reasons, and carries a shorter notice period (often 7 to 15 days) until confirmation. Issue a formal confirmation letter, since probation does not always end on its own.

No single central law defines a probation period. It is governed mainly by the state Shops and Establishments Act, standing orders where they apply, and the employee's appointment letter. That is why practice varies so widely, and why the paperwork matters.

What employers should get right
| Point | Common practice |
|---|---|
| Length | Usually 3 to 6 months. Some states and categories have limits |
| Extension | Allowed once or twice if the appointment letter permits it, with a written notice stating the reasons |
| Notice period | Often shorter during probation, such as 7 to 15 days, and longer after confirmation |
| Confirmation | Given by a written letter |
| Leave | Often reduced during probation, as stated in policy |

The key risk: silent probation
Probation does not always end automatically. If the period lapses and no confirmation or extension letter is issued, it becomes unclear which notice period and termination rules apply, and that uncertainty usually favours the employee in a dispute.
What to put in the appointment letter
- ✓The length of probation and the right to extend it
- ✓The notice period during and after probation
- ✓The criteria for confirmation
- ✓What leave and benefits apply during probation

A review process
- Set the end date in your system when the person joins.
- Hold reviews at the halfway point and just before the end.
- Record feedback against the criteria.
- Decide in time. Confirm, extend with reasons, or end employment according to the terms of the letter and the law.
- Issue the letter the same week.
Ending employment during probation
Even then, follow the process in your contract and state law. Give notice or pay in lieu as stated, and keep a record of the reasons. Take legal advice if the person has been with you for a long time or the matter is sensitive.
Use reminders
Rely on a system reminder for the end date, not on a manager's memory. A short alert two weeks before the end gives time to decide.
Payroll points
Check PF and ESI enrolment from the first day of employment, even if the person is on probation. Some employers delay it by mistake.
