How to Design a Leave Policy That Employees Understand and HR Can Run
A good leave policy lists each leave type with its quota, how leave accrues, carry-forward and encashment rules, probation treatment, notice for planned leave, any sandwich rule and who approves. It cannot go below legal minimums, such as 26 weeks of maternity leave for eligible women. Write it in plain language, with a table.

A leave policy answers the questions employees ask most: how much leave do I get, when can I use it, and what happens to what I do not use. Unclear answers lead to inconsistent decisions, so write the policy once and make it easy to follow.

Start with the legal floor
State shops and establishments acts, the Factories Act and the Maternity Benefit Act set minimum entitlements. Examples include paid weekly rest, national and festival holidays, and maternity leave of 26 weeks for eligible women. Your policy cannot go below these.

Common leave types
- ✓Casual leave: Short, unplanned absences.
- ✓Sick leave: Illness, sometimes with a doctor's certificate after a few days.
- ✓Earned or privilege leave: Accrues with service and can be carried forward or encashed.
- ✓Maternity and paternity leave: As per law and company benefit.
- ✓Compensatory off: For work done on weekly offs or holidays.
- ✓Leave without pay: When no balance remains.
Decisions to make
- ✓Accrual: Credit leave monthly, quarterly or at the start of the year.
- ✓Carry-forward: Allow a limit, or let balances lapse.
- ✓Encashment: Allow at exit, annually, or both.
- ✓Probation: Reduced or no leave during probation.
- ✓Notice for planned leave: For example, a week for more than three days.
- ✓Sandwich rule: Whether weekends and holidays between leave days are counted.

Approval workflow
Define who approves, how quickly, and what happens when the manager is absent. Provide an escalation path so leave requests do not sit in a queue.
Write it clearly
- ✓Use plain language and examples.
- ✓Give a table of types, quotas and rules.
- ✓State how half-days and short leave are handled.
- ✓Say what counts as misuse and what the consequence is.
Keep it fair
Apply the same rules to all employees in the same category. Exceptions should be rare, documented and approved by a named person.
Review yearly
Check the policy against new laws, workforce feedback and leave patterns. High unused leave can hint at burnout.
A leave policy is a promise about time, so it should be simple enough to keep.
Leave management software enforces the rules automatically, keeps balances accurate and gives employees a clear view of what they have.
