GST Returns Older Than Three Years Can No Longer Be Filed: What to Do Now
GST returns, including GSTR-1, GSTR-3B and GSTR-9, cannot be filed once three years have passed from their due date. The portal enforces this, so returns from late 2023 are now reaching the limit. File pending returns oldest first before their bar dates; tax for a barred period can still be assessed.

Many small businesses have a few old GST returns they meant to file "when things settle down". That option has ended. The GST portal no longer accepts a return once three years have passed from its due date.

The rule
The Finance Act, 2023 added a three-year limit to the return sections of the CGST Act, and Notification 28/2023-Central Tax brought it into force. GSTN began enforcing it on the portal in 2025. Once three years have passed from the due date, the portal will not accept these returns:
- ✓GSTR-1 (outward supplies)
- ✓GSTR-3B, GSTR-4, GSTR-5, GSTR-5A, GSTR-6 (periodic returns)
- ✓GSTR-7 and GSTR-8 (TDS and e-commerce TCS returns)
- ✓GSTR-9 (annual return)
Which returns are reaching the bar now
| Return | Due date | Cannot be filed after |
|---|---|---|
| GSTR-3B for October 2023 | 20 November 2023 | 20 November 2026 |
| GSTR-3B for November 2023 | 20 December 2023 | 20 December 2026 |
| GSTR-9 for FY 2022-23 | 31 December 2023 | 31 December 2026 |
| GSTR-1 for December 2023 | 11 January 2024 | 11 January 2027 |
Every month from now, another month of 2023-24 returns drops out of reach. Due dates above are the normal ones. If a due date was extended for your state or category, the three years run from the extended date.
What happens if a return is barred
- ✓You cannot file it. No late fee or request reopens the portal for that period.
- ✓The tax is not forgiven. The department can assess tax for a period with no return, using best judgement under Section 62 of the CGST Act, and add interest and penalties.
- ✓Your customers may lose credit. If GSTR-1 was never filed, your buyers' credit on those invoices was never in their GSTR-2B.
- ✓Your registration is at risk. Not filing returns is a ground for cancellation, and later returns may be blocked while earlier ones are pending.
What to do this month
- Open the return dashboard on the GST portal and list every unfiled return, starting with the oldest.
- Note the bar date for each: due date plus three years.
- File the oldest first. Returns usually have to be filed in order, so one missing month can hold up the rest.
- Pay the tax, interest and late fee shown. They are far smaller than an assessment with penalties.
- If a return is already barred, speak to your chartered accountant before the department contacts you. A voluntary payment through DRC-03 with a clear explanation is usually better than waiting.
Frequently asked questions
Does the limit apply to nil returns?
Yes. A nil GSTR-3B is still a return and is blocked after three years.
Can I still pay tax for a barred period?
Yes. Tax can be paid through Form DRC-03. Discuss with your CA how to report it.
Can a barred GSTR-1 be filed so my customer gets credit?
No. That is one reason to file outward supply returns on time: your customers' credit depends on them.
